These Terms & Conditions (“Terms”) apply to your use of the Neera Swim website, including browsing our website, placing an order and purchasing our products.

The website and products are operated under the trading name Neera Swim (“Neera Swim”, “Neera”, “we”, “us” or “our”), based in Malta.

By accessing or using our website, you agree to these Terms. Please read them carefully before placing an order.

These Terms should be read together with our Privacy Policy and Returns & Refunds Policy, which form part of these Terms.

Nothing in these Terms is intended to exclude, restrict or limit any consumer rights or remedies that cannot legally be excluded or limited under applicable law.

1. USING OUR WEBSITE

You may use the Neera Swim website only for lawful purposes and in accordance with these Terms.

You agree not to:

• use the website for any unlawful, fraudulent or malicious purpose;
• interfere with or attempt to compromise the operation or security of the website;
• introduce viruses, malware or other harmful material;
• attempt to gain unauthorised access to our website, systems or accounts;
• use automated systems to scrape, copy, extract or collect content or data from our website without our prior written permission;
• reproduce, copy, distribute or commercially exploit our website or its content without our prior written permission; or

2. OUR PRODUCTS

We take care to ensure that product descriptions, photographs, colours, measurements and other information displayed on our website are as accurate as reasonably possible.

Colours may appear differently depending on your device, screen settings and lighting conditions. Product imagery is intended to provide a representation of the product and may not always reflect its exact appearance in every environment.

Minor variations in colour, print placement, texture or finish may occur as a result of manufacturing processes and the nature of the materials used.

We reserve the right to make reasonable changes to our products where necessary to improve the product, maintain quality or accommodate manufacturing requirements.

Such changes will not affect your statutory rights.

3. PRE-ORDERS

Certain Neera Swim products are offered on a pre-order basis.

When you place a pre-order, you are purchasing a product that is being produced or prepared for future dispatch rather than a product that is immediately available for shipment.

Our current estimated pre-order timeframe is approximately four weeks.

The four-week timeframe is an estimate rather than a guaranteed delivery date. Production, quality control, fulfilment or shipping circumstances may occasionally cause a delay.

We will make reasonable efforts to keep you informed if there is a material delay affecting your order.

Payment may be taken in full when you place your pre-order.

If we are unable to fulfil your order, we will notify you and provide an appropriate refund or other remedy in accordance with applicable law.

Where applicable law gives you a right to cancel an order or withdraw from a purchase, that right will not be affected by these Terms.

If an order contains both pre-order and immediately available products, we may ship the order together once all products are available unless otherwise agreed with you.

4. PLACING AN ORDER

When you place an order through our website, you are making an offer to purchase the products selected by you.

After placing an order, you will receive an order confirmation email acknowledging receipt of your order. This confirms that we have received your order but does not necessarily mean that your order has been accepted.

Your order is accepted when we confirm that it has been accepted and is being processed.

We reserve the right to refuse or cancel an order where permitted by law, including where:

• a product is unavailable;
• there is an obvious error in the product description or price;
• we reasonably suspect fraudulent or unauthorised activity;
• we are unable to fulfil the order; or
• we are required to do so by law.

If we cancel an order after payment has been taken, we will refund the amount paid for the cancelled order.

Please review your order carefully before submitting it. We may not be able to make changes to an order once it has been accepted or entered into production.

5. PRICES, TAXES & DUTIES

All prices displayed on the Neera Swim website are stated in the currency shown at checkout.

Unless otherwise stated, the final price displayed at checkout includes applicable taxes, duties and import charges for the destination selected by the customer.

We aim to ensure that the price you see at checkout represents the total amount payable to Neera Swim for your order, including applicable duties and taxes.

Shipping charges, where applicable, will be displayed separately at checkout before you complete your purchase.

Prices may change from time to time. However, changes will not affect an order that has already been accepted.

If a tax, duty or other charge is unexpectedly imposed by a destination authority after an order has been placed, we will assess the circumstances and communicate with you as appropriate.

6. PAYMENT

We accept the payment methods displayed at checkout.

By submitting payment information, you confirm that:

• the information provided is accurate and complete;
• you are authorised to use the payment method; and
• you authorise us or our payment service provider to charge the applicable amount.

Payments are processed through third-party payment providers. Neera Swim does not generally have access to your complete payment-card details.

We reserve the right to refuse or cancel transactions where we reasonably suspect fraud, unauthorised use or other unlawful activity.

7. SHIPPING & DELIVERY

We ship to the destinations available at checkout.

Available shipping options and applicable shipping charges will be displayed before you complete your purchase.

Delivery times are estimates unless we expressly state otherwise.

For pre-order products, the estimated four-week pre-order timeframe applies before dispatch. Once an order has been dispatched, the delivery timeframe will depend on the shipping method and destination selected.

We are not responsible for delays caused by circumstances outside our reasonable control, including carrier delays, customs processing, strikes, severe weather, natural disasters, government restrictions or other events beyond our reasonable control.

We will, however, comply with any mandatory consumer rights relating to delayed or failed delivery.

You are responsible for providing a complete and accurate delivery address.

If an order is returned to us because an incorrect or incomplete address was provided, or because delivery was refused or not completed for reasons attributable to the customer, additional shipping charges may apply before the order can be resent, where permitted by law.

8. RETURNS & YOUR RIGHT TO CANCEL

We offer a 14-day return period for eligible online purchases.

For customers who have a statutory right of withdrawal under applicable consumer law, the withdrawal period generally begins when you, or a person you nominate other than the carrier, physically receive the goods.

If you wish to exercise your right to withdraw from a purchase, you must notify us within the applicable withdrawal period.

After notifying us, you must return the applicable product within the period required by applicable law.

Unless otherwise required by law or expressly stated by Neera Swim, the direct cost of returning an unwanted product is the customer's responsibility.

Products should be returned unworn, unused and in their original condition, with all tags, hygiene protection and original packaging intact.

You may inspect the product to the extent reasonably necessary to establish its nature, characteristics and functioning. However, you may be responsible for any diminished value resulting from handling beyond what is reasonably necessary to inspect the product.

Nothing in this section limits any statutory right of withdrawal or other consumer protection right available to you.

9. REFUNDS

Where you validly exercise a right to withdraw from a purchase, we will process your refund in accordance with applicable law and our Returns & Refunds Policy.

Refunds will generally be made using the original payment method.

Where required by applicable law, refunds will include the standard delivery charge originally paid by the customer. Additional charges arising from a customer's choice of an enhanced or premium delivery service may not be refundable where permitted by law.

We may withhold reimbursement until we have received the returned goods or you have provided evidence that the goods have been returned, whichever occurs first, where permitted by applicable law.

10. EXCHANGES

If you would prefer a different size or product, please refer to our Returns & Refunds Policy for our current exchange process.

An exchange may be subject to product availability.

Nothing in our exchange policy limits your statutory rights.

11. FAULTY, DAMAGED OR INCORRECT PRODUCTS

We want every Neera Swim order to arrive as intended.

If you receive a product that is faulty, damaged or materially different from the product you ordered, please contact us at info@neeraswim.com.

Please provide your order number and photographs where appropriate so that we can assess the issue.

Depending on the circumstances and applicable law, we may offer a repair, replacement, refund or another appropriate remedy.

Nothing in these Terms excludes or limits your legal rights in relation to faulty, defective or incorrectly supplied products.

12. INTELLECTUAL PROPERTY

All content on the Neera Swim website, including but not limited to:

• the Neera Swim name and logo;
• brand identity and trademarks;
• product names and designs;
• photographs and imagery;
• videos;
• graphics;
• written content;
• website design and layout;
• product descriptions; and
• other creative materials

is owned by or licensed to Neera Swim and is protected by applicable intellectual property laws.

You may access and use the website for your personal, non-commercial purposes.

You may not copy, reproduce, modify, distribute, publish, sell, licence or commercially exploit our content without our prior written permission.

Nothing in these Terms grants you ownership of or any licence to Neera Swim's intellectual property except where expressly stated.

13. CUSTOMER REVIEWS & CONTENT

If you submit a review, photograph, video, comment, testimonial or other content to Neera Swim (“Customer Content”), you confirm that you have the right to submit that content and that it does not infringe the rights of another person.

By submitting Customer Content, you grant Neera Swim a non-exclusive, worldwide, royalty-free licence to use, reproduce, display, publish and share that content in connection with Neera Swim, including for marketing and promotional purposes.

We will not use Customer Content in a manner that falsely suggests that you endorse a particular product or statement where this is not the case.

We may remove Customer Content where we reasonably believe it is unlawful, misleading, offensive, defamatory, infringes another person's rights or otherwise does not comply with these Terms.

You retain ownership of your Customer Content.

Where applicable law does not permit a particular limitation of liability, that limitation will apply only to the maximum extent permitted by law.

18. EVENTS OUTSIDE OUR CONTROL

We will not be responsible for any failure or delay in performing our obligations where the failure or delay results from circumstances beyond our reasonable control.

These circumstances may include natural disasters, severe weather, war, terrorism, civil unrest, strikes, labour disputes, government restrictions, supply-chain disruption, manufacturing delays, transportation disruption, epidemics, pandemics, internet or telecommunications failures or other events beyond our reasonable control.

Where such an event occurs, we will take reasonable steps to minimise its impact and keep you informed where appropriate.

19. SUSPENSION OR TERMINATION

We may suspend or terminate your access to our website where we reasonably believe that you have materially breached these Terms or have used our website unlawfully.

They replace any previous terms or agreements relating to the same subject matter, except where otherwise expressly agreed.

24. GOVERNING LAW

These Terms shall be governed by the laws applicable in Malta, subject to any mandatory consumer protection laws that apply to you in your country or place of residence.

Nothing in this section prevents you from exercising any mandatory rights or remedies available to you under applicable consumer protection law.
